(1) If the amount of debt, interest and damages cannot be recovered from the amount obtained during the auction sale of the mortgaged property, the right of the person who has to recover the remaining arrears shall be enjoyed by Nepal. The property in any place should be auctioned and recovered within one year following the procedure of Rule 25.
(2) In the case of the loan taken by Mohi, the money earned by him shall be sold at auction and the amount of debt, interest and damages shall be recovered.
(3) In case of auction sale according to sub-rules (1) and (2), after deducting the amount of interest, interest and damages up to the day of auction sale, the remaining amount shall be returned to the concerned person.
